Terms of Service

These Terms of Service (“Terms”) govern your use of the Model Box website and application (“Service”), operated by Chunk Creations Sp. z o.o. (“we,” “us,” or “our”). By using the Service, you agree to these Terms in full. If you do not agree with any part of these Terms, please do not use the Service.

1. Description of the Service

Model Box is a web application for managing miniature painting catalogues. The Service allows you to, among other things:

Browse paint catalogues from various manufacturers
Search for color matches and equivalents across brands
Manage your personal paint collection
Create shopping lists and color palettes

The Service requires a paid subscription. New users receive a 30-day free trial without the need to provide a credit card. Details about pricing are provided on our website. Using the Service requires creating an account.

2. Registration and User Account

To access the full functionality of the Service, you may need to create an account. By registering, you agree to:

Provide accurate and up-to-date information
Keep your account access secure
Promptly notify us of any unauthorized access to your account

You are responsible for all activities that occur under your account. Each account may only be used by a single individual.

3. Acceptable Use

When using the Service, you agree to:

Comply with all applicable laws and regulations
Not infringe on the intellectual property rights of third parties
Not use the Service in any way that could damage, overload, or impair its operation
Not attempt to gain unauthorized access to systems or data
Not use automated tools, scripts, bots, crawlers, scrapers, or any other automated means to access, query, or collect data from the Service or its API
Not systematically download, extract, harvest, or compile data from the Service, whether manually or through automated means, for any purpose including the creation of a competing product or dataset
Not circumvent, disable, or interfere with any rate limiting, access controls, or other technical measures designed to protect the Service

Any violation of these restrictions may result in immediate account termination without refund, and we reserve the right to pursue all available legal remedies, including claims for damages and injunctive relief.

4. Intellectual Property

All content, trademarks, graphics, software, and other materials available through the Service are owned by Chunk Creations Sp. z o.o. or their respective owners and are protected by copyright and other intellectual property laws.

Paint names, brands, and manufacturer logos belong to their respective owners and are used for informational purposes only.

You may not copy, modify, distribute, or commercially exploit any content from the Service without our prior written consent.

Proprietary Paint Data

The paint color data, color matching algorithms, cross-brand equivalence mappings, and related datasets available through the Service (“Paint Data”) represent a substantial investment of time, effort, and resources by Chunk Creations Sp. z o.o. The Paint Data constitutes a protected database under the EU Database Directive (96/9/EC) and applicable Polish law implementing it.

You may not:

Extract, reproduce, or re-utilize all or a substantial part of the Paint Data
Repeatedly or systematically extract or re-utilize insubstantial parts of the Paint Data in a manner that conflicts with normal use of the Service or unreasonably prejudices our legitimate interests
Use the Paint Data to build, train, or improve any competing product, service, or dataset
Use the Paint Data, or any content from the Service, to train, fine-tune, or otherwise develop any machine learning model, artificial intelligence system, or similar technology
Redistribute, sublicense, or make the Paint Data available to any third party, whether for commercial or non-commercial purposes

This prohibition applies regardless of the technical means used, including but not limited to API access, browser automation, manual transcription, or any other method of extraction.

AI and Machine Learning

No content from the Service — including but not limited to the Paint Data, user interface elements, text, images, and API responses — may be used as training data for machine learning models, large language models, generative AI systems, or any other artificial intelligence technology. This applies to both commercial and non-commercial use, including academic research, unless explicit written permission has been granted by Chunk Creations Sp. z o.o.

5. User Content

By using the Service, you may create and store certain content, including but not limited to usernames, paint lists, color palettes, comments, and descriptions (“User Content”). You retain rights to your User Content, but grant us a non-exclusive, perpetual license to store and process it for the purpose of providing the Service.

Content Standards

Any User Content that is publicly visible to other users — including usernames, palette names, descriptions, and comments — must not contain:

Vulgarities, profanity, or obscene language
Slurs, hate speech, or content that targets individuals or groups based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic
Threats, harassment, bullying, or intimidation
Sexually explicit or gratuitously violent content
Spam, advertising, or unsolicited promotions
Content that impersonates another person or entity
Any other content that is abusive, offensive, or inappropriate for a general audience

We reserve the right to remove any User Content that violates these standards and to suspend or terminate the accounts of repeat offenders, without prior notice and without refund. We may employ automated moderation systems, including but not limited to AI-based content filtering, to detect and act upon prohibited content. By using the Service, you acknowledge that your User Content may be subject to automated review.

We are not responsible for User Content and do not endorse any opinions or statements expressed by users. However, we are committed to maintaining a respectful community and will act on reported violations.

6. Service Availability

We strive to maintain uninterrupted availability of the Service, but we do not guarantee continuous or uninterrupted access. The Service may be temporarily unavailable due to:

Maintenance or updates
Technical failures
Circumstances beyond our control

We are not liable for any losses resulting from the unavailability of the Service.

7. Our Commitment and Limitation of Liability

We are a small, independent team and we genuinely care about providing you with the best possible experience. We actively maintain and improve the Service, investigate issues when they arise, and work to ensure that paint color data and matching results are as accurate as we can make them. When something goes wrong, we will do our best to make it right.

That said, as a small company we need to be transparent about our legal limitations. To the maximum extent permitted by applicable law:

The Service is provided “as is” without warranties of any kind, express or implied
We are not liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the Service
We do not guarantee the accuracy, completeness, or currency of paint color information and equivalents — they are provided for reference purposes only and should not be treated as a substitute for physical color comparison

These limitations of liability do not apply to the extent that they would be inconsistent with applicable law, including consumer protection regulations.

8. Subscription and Refunds

The Service operates on a subscription basis. Payment is processed through our authentication and billing provider, Kinde. We do not directly store or access your payment card details.

If you cancel your subscription, you may request a pro-rated refund for the unused portion of your current billing period. Refund requests must be submitted by contacting us using the information provided below. Refunds will be calculated from the date the request is received, not the date of cancellation.

No refunds are issued for:

Accounts terminated due to a violation of these Terms
Periods covered by the free trial

9. Account Deletion

You may request the deletion of your account at any time by contacting us using the contact information provided below. Upon receiving your request, we will:

Deactivate your account
Delete your personal data from our active databases
Retain only data required by applicable law (e.g., for tax or accounting purposes)

Account deletion is irreversible and will result in the loss of access to all data stored in your account.

10. Service Termination

We reserve the right to:

Suspend or discontinue the Service at any time, with appropriate notice
Modify the scope and functionality of the Service

In the event of a planned discontinuation of the Service, we will notify users at least 30 days in advance, allowing for data export.

11. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a revised modification date. We will notify users of material changes through the Service or via email.

Continued use of the Service after changes are made constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Poland. Any disputes arising from these Terms shall be resolved by the competent courts in the jurisdiction of Chunk Creations Sp. z o.o., subject to mandatory consumer protection provisions that may entitle consumers to bring disputes before the courts of their place of residence.
